By purchasing, installing, running or using a SMDesign software product in any way, you indicate your acceptance of the Terms and Conditions of Use set out below. All rights are reserved.
1. Definitions
“SMDesign” hereafter shall mean SMDesign Studio.
2. Scope
The following Terms and Conditions, in their valid version at the time of ordering, apply to all orders transmitted to us electronically and are recognized by you with the placing of each order.
3. Conclusion of Contract
An order is placed by completing an order in our online store. By placing an order you make a binding offer to purchase. This offer may be accepted by us by the delivery of the product to the e-mail address specified in the order. The contract is closed by accepting the offer. After the contract is closed, you will receive your order notification by email and ordered product will be available as downloadable package under “My Account” section.
4. Contract Text
The contract text is not saved by us after the contract is closed. You can see the Terms and Conditions anytime online, store them on your computer, or print them. You can save and print your order immediately after placing it.
5. Disclaimer
Right of Withdrawal
Due to the nature of the products (software and other digital products) we grant a limited 10 days right of withdrawal starting with the day of the purchase.
Withdrawal Consequences:
In the case of a valid withdrawal the contract becomes invalid and already performed payment will be refunded (additiona fees may apply).
Withdrawal Exceptions:
Installation and customization services can’t be subject of withdrawal.
6. Payment
All payment are made trough 2CheckOut.com Inc. (Ohio, USA) as an authorized retailer for goods and services provided by SMDesign.
7. License
In accordance with these terms and conditions we grant you two possible types of license to use SMDesign’s products sold through our web site:
a) Single Magento installation license
The Magento Installation license enables you to use each individual product on a single Magento installation. You can run one or multiple stores with this license.
b) Magento Enterprise license
The Magento Enterprise license enables you to use each individual product on a single Magento Enterprise installation. You can run one or multiple stores with this license.
8. Imagery and Fonts
All imagery and fonts used in our products are an integral part of our products (or their rightful owners). You can use images and fonts only as a part of the website you build using the purchased product. You can use imagery and fonts to develop one project only. Any kind of separate usage or distribution is strictly prohibited.
9. Modifications
You are authorized to make necessary modifications to our products to fit your purposes in accordance with the type of license you acquire.
10. Unauthorized Use
You shall not offer our products or parts of them, modified or unmodified, for redistribution or resale of any kind without written permission from SMDesign. You shall not sub-license, assign, or transfer our products or parts of them to any entity.
11. Installation
Installation is a paid service which is not included in the package price and can be purchased during ordering of our product or later.
SMDesign guarantee that any purchased Magento® extension will work on default Magento’s installation without modification. Any third party extensions, scripts and changes of default Magento’s HTML and CSS structure installed before SMDesign’s extensions will not be responsibilities of SMDesign. SMDesign will not be responsible if some conflict/issue occur because of third party scripts or extensions.
12. Information Disclosure
You may not disclose any order information including, but not limited to, Order ID, download link, etc.
13. External Links
We may use third parties to provide certain services accessible through the website. Our website does not control these third parties or their services, and you agree that we will not be liable to you in any way for your use of such services.
14. Privacy Policy
We use your inventory data exclusively to process your order. All customer data is stored and processed by us in compliance with the relevant regulations of the Federal Data Protection Acts and the Tele Services Data Protection Act. At any time you have a right on free information, correction, blockage and deletion of your stored data. Please refer to info@extensionsmall.com or send us your request by mail. We will not share your personal data with third parties.
15. Final Clause
The contract is available in English.The demo stores are only for demonstration purposes. Orders placed through the demo stores will not be fulfilled. We reserve the right to change or modify these terms and conditions with no prior notice.
